第一條 適用範圍與定義
1.1 適用範圍
本條款適用於白雁時尚氣功（以下簡稱「本公司」「本協會」）所提供之所有付費課程服務，包括但不限於線上課程、直播課程及預售課程。
1.2 名詞定義

線上課程：預錄影片形式，付款後可立即觀看之課程
直播課程：按課程表進行之即時線上教學課程
預售課程：付款時尚未製作完成，預定期間內上架之課程
基本觀看期：本公司保證提供課程觀看權益之最低期限
延長觀看期：超過基本觀看期後，本公司基於善意提供之額外觀看權益

第二條 課程觀看權益與期限
2.1 基本觀看期保證

線上課程：自付款完成日起算一年基本觀看權益
直播課程：依課程表完成教學，提供適當複習及團練機會
預售課程：自課程正式上線日起算一年基本觀看權益

2.2 延長觀看服務

本公司將盡力延長課程觀看期限，惟延長觀看期為額外服務，非保證權益
課程於延長觀看期內可能因營運考量下架，本公司無需事前通知
延長觀看期內下架之課程，不構成退費事由

2.3 課程下架權利
本公司保留因技術升級、內容更新、授權到期或其他營運考量，隨時下架課程之權利，但不影響學員於基本觀看期內之既得權益。

第三條 退費條件與限制
3.1 線上課程退費條件

付款後48小時內：若觀看時數未超過課程總長度10%，可申請退費
付款後48小時後：不接受退費申請
例外情況：課程內容與購買頁面描述嚴重不符，可個案處理

3.2 直播課程退費條件

開課前：可申請全額退費（扣除手續費）
開課後：不接受退費申請
未達開班人數：全額退還學費，不收取手續費

3.3 預售課程退費條件

開課前7日以上：可申請全額退費，不收取手續費
開課前7日內：不接受退費申請

第四條 手續費標準與計算
4.1 手續費組成說明
退費手續費包含但不限於：

金融機構手續費：信用卡退刷手續費、分期付款解約費
第三方支付手續費：PayPal、綠界科技等支付平台手續費
行政處理費：退費作業、帳務處理等人工成本

4.2 手續費計算標準

4.3 手續費減免情況

因本公司教學品質問題導致之退費：僅收取實際金融手續費
因技術故障影響學習：免收行政處理費
未達開班人數：免收所有手續費

5.4 審核時程

申請確認：收件後2個工作天內確認收件
審核作業：5-7個工作天完成審核
退款處理：審核通過後於每個月第一週5號左右完成退款

第六條 不可歸責事由處理
6.1 不可抗力因素
因天災、政府政策變更、疫情管制等不可抗力因素影響課程進行時：

提供線上替代課程或延期上課
學員可選擇接受替代方案或申請退費
退費時僅收取實際產生之金融手續費

6.2 技術故障處理
因系統故障、網路中斷等技術問題影響學習：

提供技術支援協助解決
無法解決時提供補課或延長觀看期
嚴重影響學習品質時可申請部分退費

第七條 爭議處理與救濟
7.1 內部申訴機制
學員/會員對退費決定有異議時，可於收到通知後10日內提出申訴，本公司將組成審議小組重新審查。
7.2 外部調解機制
內部申訴未獲滿意結果時，雙方同意優先選擇下列機構進行調解：

中華民國消費者文教基金會
各縣市消費者服務中心
中華民國仲裁協會

7.3 法律適用
本條款之解釋與適用，悉依中華民國法律，特別是《消費者保護法》相關規定。

第八條 條款修改與通知
8.1 修改權利
本公司保留修改本條款之權利，修改時將於官網公告，並以電子郵件通知已註冊學員。
8.2 修改生效
條款修改自公告日起30天後生效，學員如不同意修改內容，應於生效前申請退費。
8.3 過渡條款
條款修改前購買之課程，學員可選擇適用舊條款或新條款較有利之規定。

第九條 其他約定事項
9.1 個人資料保護
退費申請過程中蒐集之個人資料，本公司將依《個人資料保護法》妥善保管及使用。
9.2 課程轉讓
學員因個人因素無法繼續上課時，可申請將課程權益轉讓他人，轉讓手續費為NT$200。
9.3 特殊學員優惠
持有身心障礙手冊、低收入戶證明或重大傷病卡之學員，可享有退費手續費5折優惠。

COURSE REFUND POLICY TERMS AND CONDITIONS

Entity: Bai Yin Qigong (hereinafter referred to as “Company,” “We,” “Us,” or “Our”)

ARTICLE 1 – SCOPE OF APPLICATION AND DEFINITIONS
1.1 Scope of Application
These Terms and Conditions (“Terms”) govern all paid course services provided by the Company, including but not limited to on-demand courses, live streaming courses, and pre-order courses.
1.2 Definitions
For the purposes of these Terms, the following definitions shall apply:

“On-demand Course”: Pre-recorded video content accessible immediately upon payment completion
“Live Streaming Course”: Real-time online instruction delivered according to a published schedule
“Pre-order Course”: Course content purchased prior to production completion, scheduled for future release
“Guaranteed Access Period”: The minimum duration for which the Company warrants course accessibility
“Extended Access Period”: Additional viewing privileges granted at the Company’s discretion beyond the Guaranteed Access Period
“Consumer” or “Student”: Any individual who purchases course services from the Company

ARTICLE 2 – COURSE ACCESS RIGHTS AND DURATION
2.1 Guaranteed Access Period Warranty
The Company warrants the following minimum access periods:

On-demand Courses: Twelve (12) months from payment completion date
Live Streaming Courses: Access duration as specified in course schedule, including reasonable review sessions and group practice opportunities
Pre-order Courses: Twelve (12) months from official course launch date

2.2 Extended Access Service

The Company endeavors to extend course access beyond the Guaranteed Access Period as an additional courtesy service, not as a contractual obligation
Courses may be discontinued during the Extended Access Period at the Company’s sole discretion without prior notice
Course discontinuation during Extended Access Period shall not constitute grounds for refund

2.3 Course Discontinuation Rights
The Company reserves the absolute right to discontinue any course due to technical upgrades, content updates, licensing expiration, or other operational considerations, provided such discontinuation does not prejudice students’ vested rights during the Guaranteed Access Period.

ARTICLE 3 – REFUND CONDITIONS AND RESTRICTIONS
3.1 On-demand Course Refund Eligibility

Within 48 hours of payment: Refund available if viewing time does not exceed 10% of total course duration
After 48 hours of payment: No refund applications accepted
Exceptional Circumstances: Course content materially inconsistent with purchase page descriptions may be considered on a case-by-case basis

3.2 Live Streaming Course Refund Eligibility

Prior to course commencement: Full refund available (less applicable processing fees)
After course commencement: No refund applications accepted
Insufficient enrollment: Full tuition refund without processing fees

3.3 Pre-order Course Refund Eligibility

Seven (7) days or more before course launch: Full refund available without processing fees
Less than seven (7) days before course launch: No refund applications accepted

ARTICLE 4 – PROCESSING FEES STRUCTURE AND CALCULATION
4.1 Processing Fee Components
Refund processing fees include but are not limited to:

Financial Institution Fees: Credit card chargeback fees, installment plan cancellation fees
Third-party Payment Processing Fees: PayPal, ECPay, and other payment gateway fees
Administrative Processing Costs: Refund processing, accounting, and personnel costs

4.3 Fee Waiver and Reduction Circumstances
Processing fees may be waived or reduced under the following circumstances:

Refunds due to Company teaching quality issues: Actual financial processing fees only
Technical malfunctions affecting learning experience: Administrative fees waived
Insufficient enrollment: All processing fees waived

5.3 Required Documentation

5.4 Processing Timeline

Application Acknowledgment: Within 2 business days of receipt
Review Process: 5-7 business days for completion
Refund Processing: 7-10 business days following approval

ARTICLE 6 – FORCE MAJEURE AND TECHNICAL ISSUES
6.1 Force Majeure Events
In cases of natural disasters, government policy changes, pandemic restrictions, or other force majeure events affecting course delivery:

Alternative online courses or postponement shall be provided
Students may choose to accept alternative arrangements or request refunds
Refunds shall be subject only to actual financial processing fees incurred

6.2 Technical Malfunction Resolution
For system failures, network interruptions, or other technical issues affecting learning:

Technical support shall be provided to resolve issues
Supplementary classes or extended access periods shall be offered if resolution is not feasible
Partial refunds may be available if learning quality is severely compromised

ARTICLE 7 – DISPUTE RESOLUTION AND REMEDIES
7.1 Internal Appeal Mechanism
Students may file an appeal within ten (10) days of receiving refund decisions. The Company shall convene a review panel for reconsideration.
7.2 External Mediation Services
Should internal appeals prove unsatisfactory, parties agree to prioritize mediation through:

Taiwan Consumers’ Foundation
Municipal Consumer Protection Services Centers
Chinese Arbitration Association, Taipei

7.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan), particularly the Consumer Protection Act.

ARTICLE 8 – TERMS MODIFICATION AND NOTIFICATION
8.1 Amendment Rights
The Company reserves the right to modify these Terms. Modifications shall be posted on the official website and communicated to registered students via email.
8.2 Effective Date of Modifications
Term modifications shall take effect thirty (30) days following publication. Students disagreeing with modifications may request refunds prior to the effective date.
8.3 Transitional Provisions
For courses purchased prior to term modifications, students may elect to apply either the previous terms or new terms, whichever proves more favorable.

ARTICLE 9 – ADDITIONAL PROVISIONS
9.1 Data Protection
Personal information collected during refund applications shall be handled in accordance with the Personal Information Protection Act.
9.2 Course Transfer Rights
Students may transfer course privileges to third parties due to personal circumstances, subject to a NT$200 administrative fee.
9.3 Special Student Accommodations
Students holding disability certificates, low-income household documentation, or major illness cards shall receive 50% reduction in processing fees.

MISCELLANEOUS PROVISIONS
Any matters not covered by these Terms shall be resolved in accordance with applicable laws and principles of good faith. These Terms supersede all previous versions and take effect from the publication date.

LEGAL DISCLAIMERS
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY’S LIABILITY FOR ANY CLAIMS RELATED TO COURSE REFUNDS SHALL BE LIMITED TO THE AMOUNT OF TUITION PAID. THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Severability Clause
If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity or enforceability of the remaining provisions.
Entire Agreement
These Terms, together with the Company’s Privacy Policy and Terms of Use, constitute the entire agreement between the parties regarding course refunds and supersede all prior or contemporaneous agreements.
Consumer Rights Notice
STUDENTS HAVE RIGHTS UNDER THE CONSUMER PROTECTION ACT AND OTHER APPLICABLE CONSUMER PROTECTION LAWS. NOTHING IN THESE TERMS SHALL LIMIT OR WAIVE SUCH STATUTORY RIGHTS.
